Terms Of Service

1. Rights Granted to Personal Use in Final Art
Personal Use commissions are created for the Client’s private enjoyment. The Client may not sell, reproduce, or use the work in advertising or branding.
Furthermore, the Client may not trace, alter, edit, or run the artwork created by the Artist through AI or use the artwork to train AI.
Usages of Personal Use commissions include, but are not limited to: non-monetized social media posts/avatars, private displays, and personal device wallpapers.
Any usage rights not granted are reserved to the Artist. Usage beyond that granted to the Client herein shall require payment of a mutually agreed-upon additional fee subject to all terms.
Original artwork, including sketches and any other preliminary materials, and all copyrights therein, remains the property of the Artist unless purchased by payment of a separate fee subject to all terms.
Artist retains the rights to display all work created by the Artist for this Project, including preliminary materials and final art, in Artist’s portfolios, including in print and online, and to submit such work to design periodicals and competitions.
2. Revisions
(A) Preliminary Work/Sketches: Artist agrees to (3) three no-cost revisions for rough line/color sketches in the preliminary stage, and (1) one small revision to the finished sketch, also at no additional cost. Additional fees will be charged to Client for any additional revisions, and for all revisions that reflect a new directional for the project.
(B) Finished Art: Client agrees to pay Artist an additional fee for changes requested to final art.
No additional fee shall be billed for changes required to bring final artwork up to original project description.
3. Turnaround time
Standard Turnaround time can range from 1 month to 3 months. If the Client would like to expedite the project’s deadline to less than a month, please note an additional fee of 20%-100% to the project’s total fee may be applied depending on how soon the project needs to be completed.
4. Cancellation (Refunds)
Refunds will be issued based on the amount of work completed at the time of cancellation. Fifty percent (50%) is refunded if the job is canceled before the final stage. No refund will be offered despite cancellation of the project if the art has been completed. Upon cancellation, Artist retains all the rights to the art, and all original art and copies thereof must be returned, including sketches, comps, or other preliminary materials, and Client shall permanently delete all digital copies thereof.
5. Credits
A credit line suitable to the design or context will be used. Credit line is required independent of Artist’s signature.
6. Payment
Payment must be made in full upfront prior to the start of project. There is an option for a half payment upfront if project exceeds $500 USD. The Client’s right to use the work is conditioned upon receipt of final payment and upon Client’s compliance with the terms of this Agreement.

What is Personal Use and Commercial Use?

Personal Use is for private educational or entertainment purposes. With personal use, the commissioned work cannot be used to generate profits.Commercial Use refers to any instance in which my art is directly used for profit. This includes Digital Use (Promotional Content, Cover Art, Game Art, Video/Streaming Graphics, etc.) and Merchandise Use (Stickers, Posters, Artbook, Keychains, etc.)
